{"id":445,"date":"2018-02-23T15:09:58","date_gmt":"2018-02-23T15:09:58","guid":{"rendered":"http:\/\/pipltd.ie\/?p=445"},"modified":"2018-02-23T15:14:42","modified_gmt":"2018-02-23T15:14:42","slug":"landmark-personal-insolvency-arrangement-case","status":"publish","type":"post","link":"https:\/\/pipltd.ie\/?p=445","title":{"rendered":"Landmark Personal Insolvency Case"},"content":{"rendered":"<p>A Personal Insolvency Arrangement was contested by a Vulture fund and so was sent by PIP for a Section 115A Court Review, to the High Court. <\/p>\n<p>Judge Baker in the High Court, enforced the coming into effect of the Personal Insolvency Arrangement, which reduced the Mortgage from \u20ac48,1857 to \u20ac21,7500 and wrote off Unsecured loans and Credit Card debt of 7 million Euro. <\/p>\n<p>There was a term extension on the Mortgage, and the Mortgage rate was fixed at 1.25% for the remaining 21 years of the life of the Mortgage.<\/p>\n<p>The home was not a Trophy home and was suitable for the needs of the Family.<br \/>\nThe PIA was a better outcome than Bankruptcy.<br \/>\nThe Vulture Fund was Promontory Oyster DAC.<br \/>\nRuling was delivered on February 19th 2018.<\/p>\n<p>The Mortgage was in Arrears as at 1\/1\/2015, which is essential in order to get a Section 115A Court review.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Personal Insolvency Arrangement was contested by a Vulture fund and so was sent by PIP for a Section 115A Court Review, to the High Court.
